Probation violations have two types of hearings – contested and uncontested. The first hearing is an uncontested hearing, and serves as a meeting for the probation officer and the defendant/attorney. If an agreement is not reached it is set for a contested probation violation hearing where testimony is heard and if the violation is demonstrated by clear and convincing evidence the probation can be revoked.
Common probation violations: being charged with a new crime, using drugs or alcohol, not contacting your probation officer, not attending or completing treatment, failure to pay fines/restitution, etc.
