WHAT IS HARM CAUSED BY DOG?

  • Great or Substantial Bodily Harm – a person who causes great or substantial bodily harm by negligently or intentionally permitting a dog to run uncontrolled off the owners premises, or failing to keep it properly confined, is guilty of a misdemeanor.  Subsequent violations involving the same dog are gross misdemeanors.
  • Dangerous Dogs – if a dangerous dog (i.e. a dog who has previously attacked) causes bodily injury to a person other than the owner and the owner has already been convicted of a related offense (i.e. failed to register a dangerous dog or destroys a dangerous dog’s microchip) for the same dog, then the owner is guilty of a gross misdemeanor with a maximum penalty of 1 year and/or $3,000.
  • Harm to service animal – If a service animal is harmed and cannot perform their duties when an owner negligently or intentionally allows the dog to run off, or negligently confines their dog, it is a misdemeanor with mandatory restitution for all costs associated with training a new service dog, vet bills for an injured service dog, temporary service dog and loss of income, etc...
