WHAT IS DISORDERLY CONDUCT?

Any of the following that tends to alarm, anger or disturb others:

1.                  Brawling or fighting;

2.                  Disturbing a lawful assembly or meeting;

3.                  Engages in offensive, obscene, abusive, boisterous, or noisy conduct or in offensive, obscene, or abusive language* tending reasonably to arouse alarm, anger, or resentment in others

Unlike many other statutes, the disorderly conduct charge can frequently defended against on first amendment grounds.  In fact, for language based charges the courts have greatly restricted the disorderly conduct statute to prohibit only “fighting words.”  However, this statute is still vulnerable to first amendment issues.
