Disorderly conduct is a catch-all statute for unwanted behavior and speech. Frequently tab charged by irascible police and used as a fallback charge by prosecutors looking to score a conviction by any means necessary or protect the ignoble officer from civil rights lawsuits. These charges are aggressively pursued and come with real criminal consequences. When you face a disorderly conduct charge you need swift and aggressive representation. Wainberg Morrison can guide you through the legal minefield of the criminal justice system. Call us today to schedule a free initial consultation, 651-243-2438.
Any of the following that tends to alarm, anger or disturb others:
1. Brawling or fighting;
2. Disturbing a lawful assembly or meeting;
3. Engages in offensive, obscene, abusive, boisterous, or noisy conduct or in offensive, obscene, or abusive language* tending reasonably to arouse alarm, anger, or resentment in others
Unlike many other statutes, the disorderly conduct charge can frequently defended against on first amendment grounds. In fact, for language based charges the courts have greatly restricted the disorderly conduct statute to prohibit only “fighting words.” However, this statute is still vulnerable to first amendment issues.
