Computer Theft:

  • Intentionally and without authorization accesses a computer (anything that uses electricity or magnetic impulses and has a logic, arithmetic or memory function) for the purposes of obtaining services or property (property includes computer data), OR
  • With intent to deprive the rightful owner, takes or conceals a computer or software/data on a computer.

Computer Damage:

  • Intentionally damages or destroys a computer, its components or the software and/or data contained on a computer, OR
  • Intentionally and without authorization, or with intent to defraud alters a computer, its components or the software and/or data, OR
  • Distributes a destructive computer program without authorization and with intent to destroy or damage any computer or data/software contained within.

Both are treated as a felony if the damage exceeds $500, and misdemeanors if the damage is less than $500.
