WHAT IS BURGLARY?

  • Fourth Degree: Enter into a building without permission and with the intent to commit a misdemeanor inside other than stealing.  The maximum penalty is 1 year and/or $3,000.
  • Third Degree:  Burglary where the defendant commits or intends to commit a gross misdemeanor or felony inside.  Maximum penalty of 5 years or $10,000.
  • Second Degree: Burglary in a house, bank or pharmacy, or uses a tool to gain access to property/money.  The maximum penalty is 10 years and/or $20,000.
  • First Degree: Burglary of a building while someone else is present, with a dangerous weapon, or commits an assault of a person therein.  The maximum penalty is 20 years and/or $35,000.
