WHAT IS ASSAULT?

Assault is charged by degree of severity, the most basic, Assault in the Fifth Degree, is the commission of an act with the intent to cause fear of immediate harm or death, the intentional infliction of harm on another, or the attempt to harm another.  Assault in the Fifth Degree is typically a misdemeanor but can be a gross misdemeanor in certain situations.

• Assault in the Fourth Degree is the commission of an Assault in the Fifth degree motivated by bias or committed against a police officer, firefighter, emergency room doctor, DNR employee, Nurse, vulnerable adult, reserve officer, utility employee, postal employee, correctional employee, or probation officer in the course of their duties. Assault in the Fourth Degree is typically a gross misdemeanor, but can be a felony in certain situations.
• Assault in the Third Degree is an assault of another person that causes substantial bodily harm, is committed against a child under four, or is committed against a minor by a person with a past pattern of child abuse. Assault in the Third Degree is a felony.
• Assault in the Second Degree is an assault with a dangerous weapon with a maximum penalty of 7 years.  It is a felony with a maximum penalty of 10 years if substantial bodily harm occurs.
• Assault in the First Degree is an assault where great bodily harm occurs or deadly force against a peace officer of any type while on duty.  A First Degree assault against a police officer or correctional officer in the course of their duties has a 10 year minimum and a 20 year maximum.
